Feedback from a "Non-Invitee" to Governor Napolitano's Phony 'Immigration' Meeting

This was written by Representative Russell Pearce, a member of the Arizona Legislature. He was one of the legislators that traveled yesterday to the closed meeting that was put on in Flagstaff by our iniquitous governor:

Wow what a day. As you know we were locked out of the law enforcement summit in Flagstaff that the Governor called and then missed because she was in Russia watching the ballet, 22 legislators did go (17 Patriotic Republicans including many east valley legislators and the Speaker of the House and President of the Senate) and we were turned away. In talking with of the officers they felt they made very little progress and most did not want to do much on this issue. Very disappointing.

After this Governor vetoed "every" single bill that would have had a major impact on illegals getting benefits, from voting, to local law enforcement being allowed to engage in the enforcement of criminal alien activity and we are the ones who set policy and have been engaged in this issue while she and law enforcement have sat on the sidelines as spectators. Actually the Governor has been engaged on fighting us on every issue including Prop. 200 and after it passed overwhelmingly she is still trying to stop its implementation. Remember this Governor stated early on she believes illegal aliens should have driver licenses.

This governor has worked very hard to make sure we do nothing to deter illegal alien activity in this state and now after vetoing bills that would make a difference she wants a summit on the very issue and yet does not attend, but orders it closed to legislators and the press. She has not once in two years come to any of us at the legislature and offer to work with us on this the #1 issue facing this state. However, being very Clintonish she tries to convince Arizona she is tough on illegal immigration.

To show how critical this issue is to Arizona (and America) I was on Fox News (Bill O'Reilly), CNN (Lou Dobbs), all the major TV stations, I was a guest on 5 talk radio shows from 30 minutes to one hour in duration today (KFYI, KTAR (3 separate shows), and the Patriot. I am sure we will be in the newspapers tomorrow (I always worry about a spin) and more radio. In fact I start out at 7:30 on the Laura Ingram show 960AM the Patriot. (others were also)

Immigration Bills the Gov. Vetoed:

SB1306 (Pearce) Authorizes peace officers to investigate, apprehend, detain or remove aliens in the enforcement of United States immigration laws. Already authorized under federal law and April 1st a landmark decision by the U.S. Supreme Court raised any concerns on this issue and made it clear that law enforcement can enforce immigration laws. Any decision by local law enforcement not to enforce these laws is simply political on the part of local politicians and Police Chiefs and Sheriffs.

SB1118 (Pearce) Voter registration; provisional ballot; address, implements the voting-related provisions of Prop. 200

SB1167 (Pearce) Establishes English as the official language of Arizona and requires that official actions be conducted in English and requires the State to do all it can to enhance and promote English as the Official Language.

SB1402 (Pearce) Part of the initially vetoed budget bills (was a separate bill was decided to put it in the budget) that appropriates $721,700 from the HURG fund to establish procedures to determine whether or not the information and documents provided by a person applying for a driver license are fraudulent. As a result of a federal sting we found hundreds of documents being submitted to MVD were accepted and licenses were issued and Homeland Security issued a warning of severe concern to national security and on this issue and yet our Governor still vetoed the bill.

HB2030 (Pearce/Boone) Requires that recipients of certain state - funded services are presently legally in the Unites States. Also requires the agencies that provide these services to report on the number of people who applied to participate in the programs and the number who were not eligible for those programs due to their illegal status.

HB2709 (Jones/Weiers) Requires DOA to contract for a private prison facility to be located in Mexico to house Mexican National prisoners.

SB1186 (Martin) Incorporates into statue Prop. 200 requirement for proof of United States citizenship when registering to vote and stipulates the information submitted as evidence of citizenship does not become public record.

SB1511 (Martin) Prohibits law enforcement of other government agencies, commissions, boards or districts from accepting identification document such as a Matricular Consular care unless they are issued by a political subdivision, Indian Tribe, state or federal authority. Against warnings by the FBI, Homeland Security as unreliable and a serious risk to national security. She vetoed it anyway. Its only purpose is to allow illegal aliens to get public services.

LAWS NOT BEING ENFORCED:

8 USC Sec. 1325 (ILLEGAL ENTRY)
8 USC Sec. 1324 (Hiring an ILLEGAL)
8 USC Sec. 1644 ("No local ordinance, rule, or measure shall stop law enforcement officers from enforcement of this section")

8 USC Sec. 1325
Any alien who -

1. enters or attempts to enter the United States at any time or place other than as designated by immigration officers, or
2. eludes examination or inspection by immigration officers, or
3. attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact, shall, for the first commission of any such offense, be fined under Title 18 or imprisoned not more than six months, or both, and, for a subsequent commission of any such offense, be fined under Title 18, or imprisoned not more than two years or both.
(b) Improper time or place, civil penalties - Any alien who is apprehended while entering (or attempting to enter) the United States at a time or place other than as designated by immigration officers shall be subject to a civil penalty of -
(1) at least $50 and not more than $250 for each such entry (or attempted entry); or
(2) twice the amount specified in paragraph (1) in the case of an alien who has been previously subject to a civil penalty under this subsection. Civil penalties under this subsection are in addition to, and not in lieu of, any criminal or other civil penalties that may be imposed.
(c) Marriage fraud - Any individual who knowingly enters into a marriage for the purpose of evading any provision of the immigration laws shall be imprisoned for not more than 5 years, or fined not more than $250,000 or both.
(d) Immigration-related entrepreneurship fraud - Any individual who knowingly establishes a commercial enterprise for the purpose of evading any provision of the immigration laws shall be imprisoned for not more than 5 years, fined in accordance with title 18, or both.

Section 1324a states: "Any person who knowingly hires/harbors/transports any illegal alien is guilty of a felony punishable by 10 years jail + $2000 fine per illegal alien + forfeiture of the vehicle or property used to commit the crime".

Section 1324c states, "All officers whose duty it is to enforce criminal laws shall have authority to make arrests for a violation of any provision of this section" (affirmed US v Perez-Gonzalez 2002 Fed App 0360, 6th Circ.).

Section 1644, same title states, "No local ordinance, rule, or measure shall stop law enforcement officers from enforcement of this section" (affirmed Southern District Court of NY, US v Rudy Guiliani,19

How - if this governor has vetoed and blocked everything the good citizens of Arizona are trying to put into place to get control of the illegal alien situation - HOW can putting a measely twelve DPS officers "on it"...HOW is that going to make a difference??

This do-nothing, vote-buying governor has GOT TO GO...

Someone here in Arizona said the following:

Our governor is a power-hungry politico who MUST be tossed out on her ear - or we're going to have to rename the state Mexizona. The state's budget has TRIPLED since 1990, and a vast majority of the battles this year alone were over the illegals draining our social services AND education budgets. Unless you want to continue to redistribute your own hard earned dollars to people who enter this country illegally, you'd better start thinking about who to run for Governor in '06. WAKE UP ARIZONANS!!!!!!!
